DACA May Be Restored

Another federal judge has ruled against President Trump on his attempted shutdown of the DACA Program. This Order came from District Court Judge John Bates in D.C. And he ordered Trump to restart in full the Deferred Action for Childhood Arrivals. The order will not become effective until August 23 to allow DHS time to appeal if it decides to do so. If this order is not appealed, this means DACA will be restored and all qualified DACA candidates can renew or apply even if they have not had DACA before.

DHS filed a motion to reconsider which the judge promptly denied: “The court has already once given DHS the opportunity to remedy these deficiencies — either by providing a coherent explanation of its legal opinion or by reissuing its decision for bona fide policy reasons that would preclude judicial review,” said Bates, “So it will not do so again.”
